Human Resources Specialist (Employee Relations/Labor Relations)

The primary purpose of this position is to provide operations, guidance, processes, and expertise in the methods used in employee relations and labor relations functions in the Human Resources Management and Consulting Services (HRMACS) office. As a Human Resources Specialist (Employee/Labor Relations), the employee works as a member of HRMACS Employee/Labor Relations Office and in conjunction with Human Resources and Staffing Service Network (HR&SS) while coordinating with Recruitment and Staffing Services (R&SS), and VHACO Servicing HR Office (VSHO). The employee oversees contract administration functions for all collective bargaining agreements, and provides technical advice on matters under investigation, and for developing proposed disciplinary and adverse actions. S/he represents the VA in litigation before the Federal Labor Relations Authority (labor relations matters), the Equal Employment Opportunity Commission (discrimination matters), the Merit Systems Protection Board (employee relations matters), the U.S. Office of Special Counsel (ethical matters), or the U.S. Department of labor (Workers' compensation matters). The Incumbent provides advice and assistance to managers and supervisors regarding all of these complex areas.
Major duties and responsibilities include:
  • Advising senior management on a wide range of difficult and complex conduct and performance issues encompassing all areas of concern (leave and absences, hours of work, incentive awards, supervisory records, code of ethics, drug and alcohol abuse, unemployment compensation, grievances/complaints/appeals, disciplinary and adverse actions, etc.)
  • Preparing and/or assisting senior management in responding to both administrative and union grievances and ensuring responses are in compliance with regulations/union contracts and are legally sufficient.
  • Interpreting employee and labor relations laws, regulations, rules, and local policies for management and conducting extensive research to resolve complex, controversial problems.
  • Preparing responses to Merit Systems Protection Board appeals, grievances, Unfair Labor Practice complaints, EEO complaints, Congressional inquiries, inquiries from the VHA Central Office, and, other Federal agencies.
  • Participating in meetings with managers and supervisors and provides advice on a variety of negotiated and
    administrative procedures and issues pertaining to all areas of employee and labor relations.

Time-In-Grade Requirement: Applicants who are current Federal employees and have held a GS grade any time in the past 52 weeks must also meet time-in-grade requirements by the closing date of this announcement. For a GS-12 position you must have served 52 weeks at the GS-11. The grade may have been in any occupation, but must have been held in the Federal service. An SF-50 that shows your time-in-grade eligibility must be submitted with your application materials.

Provide a copy of your last or most recent SF-50, "Notification of Personnel Action" to indicate your current federal status. You must also submit additional SF-50(s) to clearly demonstrate one year time-in-grade as required in the announcement. If the most recent SF-50 has an effective within the past year, it may not clearly demonstrate that you possess one year time-in-grade. In this instance, you must provide an additional SF-50 that clearly demonstrates one year time-in-grade.

Time-In-Grade requirements also apply to former Federal employees applying for reinstatement as well as current employees applying for Veterans Employment Opportunities Act of 1998 (VEOA) appointment.

You may qualify based on your experience, as described below:
Specialized Experience: You must have one year of specialized experience equivalent to at least the next lower grade GS-11 in the normal line of progression for the occupation in the organization. Specialized experience includes planning, developing, and carrying out the full range of employee and labor relations assignments and management advisory services which includes the following: reviewing, troubleshooting, and resolving difficult employee and labor relations issues; interpreting employee and labor relations laws, regulations, rule, and local policies for management; researching case decision for grievances, bargaining, and negotiations; providing advice to managers and supervisor pertaining to union demand to bargain and request for information; advising senior management and supervisor on the procedural and legal requirements for correcting complex conduct and performance problems and administering disciplinary and adverse actions.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religions; spiritual; community; student; social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

Note: A full year of work is considered to be 35-40 hours of work per week. Part-time experience will be credited on the basis of time actually spent in appropriate activities. Applicants wishing to receive credit for such experience must indicate clearly the nature of their duties and responsibilities in each position and the number of hours a week spent in such employment.

Physical Requirements: The work is primarily sedentary, although some slight physical effort may be required. Public speaking is required therefore employee must be able to travel.
